Department of Justicelessness…

I’m pissed off.  Barack Obama’s Department of ‘Justice’ is really screwing the pooch. When it comes to blatant violations of Federal Laws and out and out War Crimes, these clowns are trying wildly succeeding at topping Alberto “Torture Guy” Gonzales’ Keystone Cops er minions um partisan hacks Justice Department.

First comes a case where an Ethiopian national is taken to secret prisons in very dubious locations. He claims he was tortured and is suing the Boeing subsidiary Jeppsen for co-coordinating his transportation and thereby facilitating the alleged torture. Then a month later a case come up where a charity group called the al-Haramain Islamic Foundation was targeted by the Justice Department.  During the legal back and forth, the lawyers of the Foundation were allowed to see documentation that proved that the government was breaking its own surveillance laws before quickly retracting the documents and slapping gag orders on everyone in sight. al-Haramain sued the government for damages relating to the crimes committed under Federal Law.

In both cases the Obama lawyers in the justice department were absolutely indistinguishable from the shameless wingnuts that they replaced.  They asserted that even going forward with either case would threaten to expose state secrets and therefore the cases must be dismissed. How just.

But evidently they were just getting warmed up. The Electronic Frontier Foundation, a civil liberties group, sued the government for its warrantless wiretapping program. From their website:

Jewel v. NSA is aimed at ending the NSA’s dragnet surveillance of millions of ordinary Americans and holding accountable the government officials who illegally authorized it. Evidence in the case includes undisputed documents provided by former AT&T telecommunications technician Mark Klein showing AT&T has routed copies of Internet traffic to a secret room in San Francisco controlled by the NSA.

What? Undisputed? WTF?

So of course the Hopey, Changey, High on Transparency Obama Admin is going to make sure that we get to the bottom of this, right?

Wrong.  They decide that just asserting the states secret privilege did not go far enough.  What they now claim is that the Patriot Act prevents the government from being sued for any illegal activity relating to surveillance.  At All. Oh, unless of course there is “willful disclosure” by the government.  So let me see how this works.  We can’t call you on doing anything wrong unless you decide to tell us what you are doing.  Riiiight.

That is totally fucked up.  Completely jacked. Anyone with half a brain can see how that is going to turn out.

Us:         Hey, government. You doin’ anything we should punish you for?  Any little thing?

Gov’t:    No.

Us:         Whew.  That settles that.  What’s on TV?

By using all of this political mumbo-jumbo to hide, Obama’s shirt is smelling faintly of injustice and his sharp suit is starting to bear the stain of the blood of the tortured and tormented.  The more I am seeing of this (and don’t even get me started on the Treasury situation) the more I wonder if  Obama’s skill at oration is just an extra mesmerizing ruse in the rich and powerful’s long battle to take all the toys.

h/t to Glenn Greenwald who has been all over this in his own loquacious way.

  1. Ya think???

  2. Sadly, the “things could be worse” argument is still in Obama’s favour.

One of the things I’ve been thinking about lately is the deficit. When Reagan first started piling up the debt it was a sort of stealth move to say “See? Now we have no money for nice programs so we’ll have to cut ’em.”

Obama’s engineering an issue Republicans love to make noise about by shovelling money towards the insolvent banks (the stimulus, I think, is necessary).

  3. I don’t understand any of what is happening…. they count on the fact that few people do… we’re too busy trying to keep our heads above the cesspool..

We all expected laBUSHanostra to be dogs.

Many expected laBAMAnostra to be better (not ME!)

Many idiots are falling for statusQUObama’s loose change poetics and STILL believe the current corpoRATe criminal regime to be somehow better. We are screwed…

  5. It’s funny to watch all of the wingers writhe in agony over seeing their prophet fail once again. It appears as if the prophet is now realizing one issue at a time that the difference between campaign rhetoric and reality is vast. Your prophet is now able to see it and true to their fashion the blow hard wingers will now demonize their own for their lack of sensibility. Once these threads have been pulled the entire thing will unravel leaving leftists to wonder what the hell happened. I am amused!

  6. I am not amused with our broken-ass, bought and paid-for by corporations ‘democracy’.

The Dems are criminals and the Repubs are idiots. We’re well and truly fucked.

  8. Gave up pretty easy didn’t you. I guess you ran out of things to say when your prophet failed you again, and again, and again, and again…

Like a broken record isn’t it. Obama and his idiots, pied piper and his rats. What a fun thing it is to watch the big O’s (I think he can borrow that from Oprah, I don’t think she’d mind) supporters fall away more and more every day. Some have seen the true nature and were disgusted. Others claim he fails to represent the agenda that he ran on while others stand blind, fingers firmly planted in their ears singing LALALALALALA EVERYTHING IS FINE OBAMA IS OUR SAVIOR. Obama all the while would rather spit on you than look at you. You have all been had those of you who voted for this idiot. We will all pay for your ignorance.

    • I guess you didn’t read much of what I have written. McCain/Palin would have been worse. But Obama is screwing the pooch by continuing GWB’s lawless ways.

      Comment by t4toby — July 23, 2009 @ 2:58 pm

      • I’ve read enough to become very amused. I love how the interest has shifted from ‘Barack is our God and savior’ to ‘It’s all GWB’s fault’ to ‘McCain/Palin would have been worse’. See where this is going? It’s all a down hill slide. Lefties will say anything and blame anyone else that they can for the messes they create. Well this one is going to be a little harder to explain away and no, no one is falling for the drum beat rhetoric of McCain/Palin would have been worse. Would McCain have proposed the enormous stimulus bill that he voted against? Would he have pushed a radical overhaul of health care insurance in the middle of the crisis, especially a government option? Would he have cut missile defense funding? Would he have been in favor of cap and trade? Card check?
Would he be trying his hardest to put Chavez’s lackey Zelaya back in power? Would he have failed to offer strong support for Iran’s demonstrators? Would he have given Moscow what it wanted and cut our ability to respond to international crises in order to gain—well, basically nothing? Any thinking person knows the answers.

In fact, the only things McCain would have done that would have been the same as Obama are the cases in which Obama echoed Bush’s policies on terrorists, such as indefinite detention and warrantless wiretaps. Oh, and McCain probably would have banned waterboarding (which had ended de facto in 2003 anyway) just as Obama did.
I could list more differences, but why bother? The charge isn’t really a serious one to begin with. Like so many others on the Left it is merely a juvenile attempt at distraction, a sort of “and so’s your old man,” or “bounces off me and sticks to you,” a meaningless schoolyard taunt.

But that’s the way it is these days

  9. I actually have not seen you write much of anything lately. What’s up with that? And what’s up with demanding prosecution of Bush administration members? Is that really the precedence you’d like set? One Administration prosecutes the last? If so what is your prediction for prosecution of the Obama administration? Count one = treason.

    Comment by Trashy Leroy — July 24, 2009 @ 10:05 am

  10. I need to get back to it, I admit.

And as far as prosecutions go, don’t give me that line of BS. If our leaders break the law I don’t care what fucking letter is in parenthesis after their name. Prosecute them and let the legal system do what it was designed to do.

If Obama is guilty of treason then by all means let’s prosecute him and let the chips fall where they may. I have no more love for a Black Man for Chicago than I do a bumbling dooofus from texas. Throw the fucking crooks in prison.

    Every last one of them.

  11. Get on with it then. As a previous commenter stated you have much to say. I’m getting tired of checking your pseudo blog every day to see if you’ve posted anything new. I’m growing bored and am wondering if you have anything at all to say after all.

  16. Butler Shaffer phrased it Thusly:

“The self-interest motivations of individuals assures us that they will always act for the purpose of enhancing their lives, however they define such ends; to be better off after acting than if they had not chosen to act. Liberty is the condition in which individuals are able to act in pursuit of their highest interests. By its very nature, then, liberty enhances the quality of life.
By contrast, the state – which is universally defined as an agency with a monopoly on the use of violence within a given territory – never acts to enhance life. It is inconceivable that it could ever do so, for violence forces life to be what it does not choose to be. The state coercively restrains individuals in their efforts to better their conditions. Through taxation, inflation, eminent domain, etc., it deprives people of the resources upon which they could act to enhance their well-being; and, in the ultimate anti-life act, it kills human beings – more than 200,000,000 in the twentieth century alone – as it pursues its own destructive purposes.”

why should the controller-du-jour of the State alter it’s basic nature?

    Comment by Bill Jones — October 6, 2009 @ 5:21 pm

    • So in Mr. Shaffer’s opinion, there is only the individual, and the individual’s interest? There is no community, no other vectors or forces, just the individual’s need to do whatever it takes to please himself?

That seems irrational and selfish, not to mention dangerously immature.

      Comment by t4toby — October 7, 2009 @ 8:55 am

    • And…Where was all this righteous indignation when Bush was in office presiding over one of the biggest expansions of government in history?? All of a sudden a black man is in office and its an emergency?

Puh-lease. I was bitching then and I’m bitching now.
